In no case shall The Traveling Trader, our directors, officers, employees, affiliates, agents, contractors, interns, suppliers, service providers or licensors be liable for any injury, loss, claim, or any direct, indirect, incidental, punitive, special, or consequential damages of any kind, including, without limitation lost profits, lost revenue, lost savings, loss of data, replacement costs, or any similar damages, whether based in contract, tort (including negligence), strict liability or otherwise, arising from your use of any of the service or any products procured using the service, or for any other claim related in any way to your use of the service or any product, including, but not limited to, any errors or omissions in any content, or any loss or damage of any kind incurred as a result of the use of the service or any content (or product) posted, transmitted, or otherwise made available via the service, even if advised of their possibility. Because some states or jurisdictions do not allow the exclusion or the limitation of liability for consequential or incidental damages, in such states or jurisdictions, our liability shall be limited to the maximum extent permitted by law.
You grant to The Traveling Trader and its Third Party Providers the non-exclusive, worldwide right to use, copy, transmit and display any data, information, Content or other Materials, provided to The Traveling Trader by you in the course of accessing and/or using the Website. Notwithstanding the foregoing, The Traveling Trader obligations regarding identification and other information concerning your personal information shall be governed by the terms of the Privacy Policy. The terms of the Privacy Policy are expressly incorporated herein as though set forth in full.
NO REFUNDS
To the extent you purchase any goods and/or services from The Traveling Trader, you agree to pay for all goods and services ordered from The Traveling Trader and/or its Third Party Providers except as set forth in a writing signed by an authorized representative of The Traveling Trader. You will provide The Traveling Trader with valid and updated credit card or approved purchase order information and with The Traveling Trader and accurate billing and contact information. If you provide credit card or other authorized payment method information to The Traveling Trader, you authorize The Traveling Trader, or a credit card processor of its choosing to bill such credit card or to make such charges as applicable. If The Traveling Trader, in its sole and absolute discretion, permits you to make payment using a method other than a credit card or other authorized payment method, The Traveling Trader will invoice you at, or within a reasonable period of, the time of the purchase request. All amounts invoiced hereunder shall be due within thirty (30) days of the date of the invoice.
a) The Client acknowledges and agrees that the Services provided under this Agreement, including all videos, material, information, or lessons prepared or issued by The Traveling Trader for the use of the Client are the sole property of The Traveling Trader and The Traveling Trader shall retain all rights (including any and all trademarks, copyright, or other moral rights), titles and interest in and to the Services. No other use or distribution is authorized save as expressly allowed under this Agreement.
b) The services shall commence on the invoice date
i) For any selected programs indicated in section 1 that include support / mentorship, then the support / mentorship service will continue for the period of time indicated in that course’s / program’s description in the invoice
ii) For any selected course(s) / program(s) indicated in section 1 that DO NOT include support / mentorship, then the services provided to the Client are given under your term agreement.
c) As full payment for the Services, the Client agrees to pay the invoice fee in US dollars, via Credit
or Debit Card or Paypal in the following payment plan indicated:
i) The obligation of The Traveling Trader to perform the Services is conditional upon payment by
the Client and performance by the Client of its obligations hereunder the invoice term.
d) The Traveling Trader and all representatives of The Traveling Trader are not a licensed professional nor give investment advice. All of the content, including but not limited to, the videos, streams, investments, stocks, strategies, and trades are for entertainment purposes only, reflect only my personal views, ideas, and opinions, and should not be construed as personal investment advice. While the information is believed to be accurate, it may include errors, inaccuracies, or omissions. No representations or warranties are made in connection therewith and you should never take any of this information as guidance for buying or selling any type of investment. Nothing herein or therein shall be construed to be financial, legal, or tax advice. Purchasing equities, stocks and trading can be highly speculative and pose considerable risk of loss of your entire investment. You should always conduct your own due diligence and seek the advice and/or counsel of qualified and licensed professionals and advisors. I will not and cannot be held liable for any actions you take as a result of viewing and/or reading any of my content and/or any losses in connection therewith.
e) For all purchased support call(s) / session(s), Client acknowledges and agrees that any purchased support call(s) / session(s) are not eligible for a refund but can only be rescheduled according to the conditions and situations described above.
f) All Parties (The Traveling Trader and the Client) understand and agree that payments received for the Services are non-refundable.
In the event the Client fails to utilize the materials and resources provided by The Traveling Trader, the Client understands and agrees that the responsibility and accountability of utilization is the Client’s, and that lack of utilization will not constitute a refund of monies paid on the part of The Traveling Trader.
Furthermore, if the Client initiates a dispute or creates a chargeback with their financial institution or The Traveling Trader’s payment processor regarding the transactions mentioned in section 3 after
signing this agreement with full knowledge and understanding of the refund policy stated above, the Client acknowledges and agrees that they may be penalized with an automatically charged fee of up to $250 US Dollars for each dispute or chargeback initiated at the discretion of The Traveling Trader, regardless of the status of said dispute or chargeback to cover the cost of fees charged to The Traveling Trader along with the time and effort required to respond and provide evidence for each dispute or chargeback.
Additionally, the Client acknowledges and agrees that the initiation of a disputed transaction or chargeback will result in the suspension of access and use of all courses, materials and support as outlined in section 1 and will result in a ban from purchasing any additional courses, materials, support or other offers from The Traveling Trader for a period of time are at the discretion of The Traveling Trader.
g) The Traveling Trader binds all new students to the rules and regulations of the private community. 1) No sexual harrassment speech of any kind directed towards another member of the community 2) No racism directed towards another member of the community 3) No threats serious or otherwise are to be directed towards another member of the community 4) Do NOT post your referral links! 5) Do NOT post any self-promotion or advertising links unless you have direct consent from the adminstrator or the moderators. This includes links to your business or your personal social media accounts 6) Do NOT post any material promoting a certain cryptocurrency, project, and/or ICO 7) Public criticism in regards to Z or The Traveling Trader Program will not be tolerated in public. We always welcome feedback, but this will need to be done via submitting a ticket. Having discussions regarding these entities are perfectly fine and within the rules. If the team deems you have broken these community rules your post will be deleted. If there is an escalation you may be removed from the community.
h) The Client acknowledges and agrees that The Traveling Trader makes no claims, representations, or warranties of any kind with respect to the Services, including, without limiting the generality of the foregoing, the success, performance, or future profits of the Client related to the information and Services provided pursuant to this Agreement.
The Client hereby waives any claim that it may have against The Traveling Trader and/or its employees, agents and affiliates, and agrees to defend, indemnify, protect and hold harmless The Traveling Trader, its employees, agents and affiliates, from any and all claims, liabilities, damages, costs (including costs on a solicitor client full indemnity basis) or expenses of whatever nature, which may arise directly or indirectly, to any party, as a result of the Services provided by The Traveling Trader, its employees, agents and affiliates under this Agreement or unauthorized distribution thereof.
Each party represents and warrants that it has the power and authority to enter into this Agreement. The Traveling Trader warrants that it will provide the Website and all goods and services in a manner consistent with its business practices, as The Traveling Trader, in its sole and absolute discretion, deems fit. To the extent that you represent an entity of any type or any individual besides yourself, you represent and warrant that you have the proper authority to enter into this Agreement on their behalf.
EXCEPT WHERE EXPRESSLY PROVIDED OTHERWISE BY The Traveling Trader, THE MATERIALS ON THE WEBSITE ARE PROVIDED “AS IS,” AND ARE FOR USE AS CONTRACTED HEREIN. EXCEPT FOR THE EXPRESS WARRANTIES SET FORTH HEREIN, The Traveling Trader AND ITS THIRD PARTY PROVIDERS HEREBY DISCLAIM ALL EXPRESS OR IMPLIED REPRESENTATIONS, WARRANTIES, GUARANTIES, AND CONDITIONS WITH REGARD TO THE WEBSITE, THE MATERIALS, AND THE GOODS AND SERVICES ASSOCIATED THEREWITH INCLUDING BUT NOT LIMITED TO ANY IMPLIED REPRESENTATIONS, WARRANTIES, GUARANTIES, AND CONDITIONS OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE AND NON-INFRINGEMENT, AND QUALITY OF GOODS AND SERVICES EXCEPT TO THE EXTENT THAT SUCH DISCLAIMERS ARE HELD TO BE LEGALLY INVALID. You shall defend and indemnify The Traveling Trader and its Third Party Providers against any and all claims, costs, damages, losses, liabilities and expenses (including attorneys’ fees and costs) finally awarded against The Traveling Trader or its Third Party Providers by a court of competent jurisdiction arising out of or in connection with a claim by a third party related to you. The Traveling Trader shall have no indemnification obligation or other liability for any claim of infringement arising from (a) use of the Website and/or the goods, services or Materials associated with the Website other than in accordance with this Agreement; (b) the combination of the Website and/or the goods, services or Materials associated with the Website with any other products, services, or materials; or (c) any third party products, services, or materials.
You will comply with all applicable local, state, national and foreign laws, treaties, regulations and conventions in connection with your use of the Website, including without limitation those related to data privacy, international communications, and the exportation of technical or personal data from locations other than the location from which The Traveling Trader controls and operates the Website and services associated therewith. Furthermore, you expressly agree not to violate any rights of publicity or privacy of any person, nor defame any person or entity.
The Traveling Trader may give notice by means of a general notice on the Website, electronic mail to your email address on record in The Traveling Trader account information, or by written communication sent by first class mail or pre-paid post to your address on record in The Traveling Trader account information. You may give notice to The Traveling Trader at any time by letter sent by letter delivered by registered mail with return receipt to: 211 East 43rd Street, Suite 639 | New York, NY 10017. All notices shall be deemed to have been given four days after mailing or 36 hours after sending by confirmed facsimile, email or posting to the Website.
These Terms of Service and any separate agreements whereby we provide you Services shall be governed by and construed in accordance with the laws of the United States.
No waiver by The Traveling Trader of any term or condition set forth in these Terms of Use shall be deemed a further or continuing waiver of such term or condition or a waiver of any other term or condition and any failure of The Traveling Trader to assert a right or provision under these Terms of Use shall not constitute a waiver of such right or provision. If any provision of these Terms of Use is held by a court or other tribunal of competent jurisdiction to be invalid, illegal or unenforceable for any reason, such provision will be deemed superseded by a valid, enforceable provision that most closely matches the intent of the original provision, and the remainder of the Terms of Use shall continue in effect.
These Terms of Use and any rights and licenses granted hereunder may not be transferred or assigned by you. We may assign our rights under these Terms of Use without restriction. Any attempted transfer or assignment in violation hereof shall be null and void.
A printed version of this agreement and of any notice given in electronic form shall be admissible in judicial or administrative proceedings based upon or relating to this agreement to the same extent and subject to the same conditions as other business documents and records originally generated and maintained in printed form. It is the express wish to the parties that this agreement and all related documents be drawn up in English.
These Terms of Use and the other agreements referred to herein constitute the sole and entire agreement between you and The Traveling Trader with respect to the Website and supersede all prior and contemporaneous understandings, agreements, representations and warranties, both written and oral, with respect to the Website.
